I am a Lecturer in Civil Law at Barcelona’s University (UB). I have been conducting research at the Molengraaf Institute for Private Law (University of Utrecht, 2015, 2017) and at the Università degli Studi di Milano (2016).My main research interest lies in the field of European contractual law and the protection of the weaker party in the contract. My Ph.D. thesis focused on the institution of ‘unfair advantage’ by means of a critical analysis that highlighted the potential of the introduction of this rule in private law. The subject of the study was the utility and regulation of the so-called ‘unfair advantage’ rule, which is an effective instrument against contracts that are excessively unbalanced to the detriment of the weaker party. To that end, an autonomous legal basis was introduced on some European civil codes (drawing very clear inspiration from international, harmonising texts of European Contract Law, PICC, PECL and DCFR) for the protection of the weaker party, situated between procedural and substantive justice. I was awarded with the Extraordinary Ph.D. in Law Prize, University of Barcelona, 2018). This prize has been followed by a book on the same topic (Ventaja injusta y protección de la parte débil del contrato, Marcial Pons).I have coordinated recently a book on the standing legislation regarding inheritance in Spain (Tratado de Derecho de sucesiones vigente en España y Andorra, Thomson Reuters Aranzadi, 2020).I have published several works, mainly on topics such as contractual equilibrium, laesio enormis, legal remedies to unbalanced contracts, contractual justice and the protection of the weaker party. Furthermore, I have written on the topic of sharing economy and the regulation of the reputation feedback systems posed by the digital platforms in order to gain the trust of its users. Currently I am part of two research projects being carried out at Barcelona’s University, respectively, on sharing economy and on the contract performance on the digital age and the adaptation of contract law in order to prevent cross-border conflicts.Recently, my research is focused on the study of the legal challenges that arise from blockchain -based smart contracts and the process of contract formation, and its compatibility with existing contract law.
